Many are familiar with
the notion that Delaware has historically been a “corporate
mecca” for big businesses. Part of the draw to
Delaware is it’s Business Court system, which is designed to
hear only “business” cases. Nevada
has structured its Business Court system using Delaware as
a model. In
this way, Nevada has created a streamlined, predictable atmosphere
for entity governance.
The Nevada Secretary
of State describes the business courts as follows:

Court are to provide early, comprehensive case management
to avoid business interruption during the pending of
litigation, provide close management of factually and/or
legally complex commercial litigation, and provide consistency
of decisions to enable business planning. Along
with these goals, we want to ensure that any legal disputes
will be handled efficiently, competently, predictably,
and that they will be able to continue business activities
with minimal interruption. |
Moreover, judges in Nevada’s business court are selected based
on specialized experience in business litigation. This "hyper-qualification" enables
speedy resolution of cases.
Even within its judicial system, Nevada remains on
the "cutting
edge" of technology; the Electronic Filing Order efficiently
manages filings which results in "cutting costs" for entities.
